1. Introduction and Acceptance
These Terms and Conditions govern your use of watch repair services provided by Oscillum, located at No. 203, Zhonghua Road, Hualien City, Hualien County 970, Taiwan, and your use of our website at ossciillumokl.live.
By engaging our services or using our website, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our services.
You must be at least 18 years of age to enter into this agreement and use our services. By using our services, you represent that you meet this age requirement and have the legal capacity to enter into binding contracts.
2. Definitions
- "Service" or "Services" refers to all watch repair, servicing, and conservation work provided by Oscillum.
- "Client" or "You" refers to the individual or entity engaging our services.
- "Timepiece" or "Watch" refers to any mechanical or automatic watch brought to us for servicing.
- "Agreement" refers to these Terms and Conditions together with any service estimates and work orders.
- "We," "Us," or "Oscillum" refers to the business operating at the address stated above.
3. Service Description
Oscillum provides luxury watch repair and servicing, including but not limited to:
- Movement Health Screening and diagnostic assessment
- Thorough Mechanical Overhaul and servicing
- Collector Preservation Service for vintage and collectible timepieces
- Related horological consultation and advice
Service availability may vary depending on the specific caliber, condition, and parts availability. We reserve the right to decline work that falls outside our expertise or capabilities.
All services are performed at our workshop in Hualien, Taiwan. We do not currently offer mobile or on-site services.
4. Service Terms and Process
4.1 Initial Assessment
Upon receipt of your timepiece, we conduct an initial assessment to determine the scope of work required. You will receive a detailed estimate outlining recommended services and associated costs before any work beyond the initial assessment proceeds.
4.2 Approval and Authorization
Work will not proceed beyond the initial assessment without your explicit approval of the estimate. You authorize work by providing written or electronic confirmation of the estimate. Changes to the approved scope of work require additional authorization.
4.3 Additional Work
If additional issues are discovered during servicing, we will contact you with a revised estimate before proceeding. You may choose to authorize the additional work or collect your timepiece in its current state, subject to payment for work completed.
4.4 Service Timelines
Estimated timelines provided are approximate and subject to parts availability, workload, and complexity of repairs. While we endeavor to meet estimated completion dates, delays may occur and do not constitute breach of this agreement.
4.5 Parts and Materials
We use appropriate lubricants, replacement parts, and materials for each service. For vintage and collectible pieces, we prioritize sourcing original parts when replacement is necessary. Replaced original parts are returned to you unless otherwise requested.
5. Payment Terms
Prices for services are stated in New Taiwan Dollars (NT$) and are subject to change. The estimate provided to you will remain valid for 30 days from the date of issue.
Payment is due upon completion of services before your timepiece is released. We accept cash, bank transfer, and major credit cards. A receipt will be provided for all payments.
For services requiring parts sourcing or extended timelines, we may request a deposit of up to 50% of the estimated cost. This deposit is non-refundable if you cancel the service after parts have been ordered.
Refund Policy: If you are dissatisfied with completed work, please contact us within 7 days of collection. We will review the matter and, if warranted, re-perform work at no additional charge. Refunds are considered on a case-by-case basis and are not applicable to diagnostic assessments or services where the timepiece's condition prevents full repair.
6. Client Responsibilities
As a client, you are responsible for:
- Providing accurate information about your timepiece and its history
- Disclosing any previous repairs or modifications
- Removing valuable straps or bracelets not requiring service
- Collecting your timepiece within 90 days of notification of completion
- Maintaining appropriate insurance coverage for high-value timepieces
Timepieces not collected within 90 days of completion notification may be subject to storage fees of NT$500 per month. We reserve the right to dispose of unclaimed timepieces after 6 months, following appropriate legal procedures.
7. Limitations and Disclaimers
7.1 Service Limitations
While we employ professional techniques and equipment, mechanical watch repair is a specialized craft with inherent limitations. We cannot provide outcomes for:
- Timepieces with irreparable damage or missing critical components
- Exact original appearance of heavily aged dials or cases
- Performance beyond manufacturer specifications
- Prevention of future wear from normal use
7.2 No Guarantees of Specific Results
We make no specific results beyond those explicitly stated in your service estimate. Vintage timepieces may have tolerances different from modern standards. While we strive for optimal performance, we do not claim that serviced vintage watches will match the precision of contemporary timepieces.
7.3 Warranty on Services
We provide a 12-month warranty on labor and parts replaced during servicing, covering defects in workmanship. This warranty does not cover damage from misuse, accidents, unauthorized repairs, or normal wear. The warranty is void if the timepiece is serviced by another party during the warranty period.
8. Limitation of Liability
Oscillum maintains insurance for timepieces in our care. Our liability is limited to the lesser of the repair cost or the declared value of the timepiece, up to a maximum of NT$500,000 unless a higher value is declared and additional insurance arranged.
We are not liable for:
- Sentimental value or consequential damages
- Loss or damage caused by events beyond our control (force majeure)
- Deterioration of materials inherent to the timepiece's age or condition
- Issues not disclosed during initial assessment
In no event shall our total liability exceed the amount paid for the service in question.
9. Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of Oscillum or our licensors and is protected by Taiwan and international copyright laws.
You may view and print content for personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
10. Confidentiality
We maintain strict confidentiality regarding client information and the timepieces entrusted to our care. Details of your timepiece, its value, and servicing will not be disclosed to third parties except as required by law or with your consent.
11. Termination
Either party may terminate this agreement before work commences without penalty. Once work has begun, termination requires payment for services performed to the point of termination, including any non-refundable parts ordered.
We reserve the right to terminate our services if you breach these terms, provide false information, or engage in abusive behavior toward our staff.
12. Governing Law and Dispute Resolution
These terms are governed by the laws of Taiwan. Any disputes arising from these terms or our services shall be subject to the jurisdiction of the courts in Hualien County, Taiwan.
We encourage informal resolution of disputes. If you have a concern, please contact us directly at [email protected] or +886 3 8356 2174. We commit to working with you in good faith to resolve issues.
If informal resolution is unsuccessful, you agree to attempt mediation before pursuing litigation. Mediation shall be conducted in Hualien under Taiwan's mediation laws.
13. General Provisions
13.1 Entire Agreement
These terms, together with your service estimate and any written communications, constitute the entire agreement between you and Oscillum regarding our services.
13.2 Severability
If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full effect.
13.3 Waiver
Our failure to enforce any provision of these terms does not constitute a waiver of that provision or any other provision.
13.4 Assignment
You may not assign or transfer your rights or obligations under these terms without our written consent. We may assign our rights and obligations to a successor business entity.
13.5 Notices
All notices under these terms must be in writing and sent to the contact information provided. Notices are deemed received when delivered in person, three days after posting by mail, or immediately when sent by email to the addresses on record.
14. Changes to These Terms
We reserve the right to modify these terms at any time. Changes will be posted on our website with an updated effective date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. Material changes will be communicated to active clients via email.
